Privacy Policy

1. Scope and Who We Are
This Policy applies to personal information we process about users of the Gecko web application and websites (the “Service”). Atomic Venture (“we,” “us,” or “our”) is the business responsible for that information. By using the Service you acknowledge this Policy, which is incorporated into our Terms of Service.
2. Information We Collect
We collect the following categories of personal information:
Information you provide
- Account information — your email address and a securely hashed password. We never store your password in plain text.
- Profile and onboarding information — instruments you trade, stated account size, daily loss limit, and goals you enter.
- Trading data you upload — trade history, fills, and account or daily statements from brokers such as Kraken, Robinhood, and Interactive Brokers, including instruments, prices, quantities, timestamps, fees, and profit-and-loss figures.
- Journal and feedback content — notes you write in the journal and messages you send through the in-app feedback form.
Information collected automatically
- Usage and device data — IP address, browser and device type, pages viewed, and actions taken, collected through server logs and standard web technologies to operate and secure the Service.
- Authentication cookies — a strictly necessary cookie that keeps you signed in. See Section 6.
Information from third parties
- Payment information — when you subscribe, our payment processor (Stripe) processes your card details and provides us with limited information such as a customer identifier and subscription status. We do not receive or store full card numbers.
We do not intentionally collect Social Security numbers, government identifiers, precise geolocation, biometric data, or other sensitive categories, and we ask that you not upload them.
3. How We Use Information
We use personal information to:
- create and administer your account and authenticate you;
- provide the Service — journaling your trades and generating analytics, scores, summaries, and educational commentary;
- process subscriptions, billing, and renewals;
- respond to feedback, support requests, and complaints;
- send service-related and transactional emails (for example sign-in links and account notices);
- secure the Service, prevent fraud and abuse, and debug;
- maintain, analyze, and improve the Service, including with aggregated and de-identified data; and
- comply with legal obligations and enforce our Terms.
We process this information to perform our contract with you, for our legitimate business interests in operating and improving the Service, with your consent where required, and to comply with law.
4. How We Disclose Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose personal information only as follows:
- Service providers / processors — vendors that process data on our behalf and under contract solely to provide services to us, including cloud hosting and database providers, our payment processor (Stripe), and our transactional email provider. They are not permitted to use the data for their own purposes.
- Legal and safety — when we believe disclosure is reasonably necessary to comply with law, legal process, or a government request, to enforce our Terms, or to protect the rights, property, or safety of any person.
- Business transfers — in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
- With your direction or consent — when you ask us to share information.
5. CCPA Disclosures — Categories
In the preceding 12 months we have collected the following CCPA categories of personal information: identifiers (e.g., email, IP address); commercial information (subscription and transaction records); financial / trading information (the trade data and statements you upload); internet or other electronic network activity (usage and log data); and inferences (behavioral pattern scores derived from your trade data). We collect these from the sources in Section 2 and use and disclose them for the purposes in Sections 3 and 4. We have not sold or shared (as those terms are defined by the CCPA) any personal information, and we do not knowingly do so for consumers under 16.
6. Cookies and Tracking
We use a single strictly necessary, first-party cookie to keep you signed in. We do not use third-party advertising cookies or cross-site tracking. Because the authentication cookie is essential to the Service, disabling it will prevent you from signing in. We do not currently respond to browser “Do Not Track” signals; however, because we do not sell or share personal information or serve targeted advertising, an opt-out preference signal does not change our practices.
7. Data Retention
We retain personal information for as long as your account is active and as needed to provide the Service, and thereafter for the period reasonably necessary to comply with legal obligations, resolve disputes, prevent fraud, and enforce our agreements. When you delete your account, we delete or de-identify the personal information associated with it within a commercially reasonable period, except information we are required or permitted by law to retain. Aggregated and de-identified data, which cannot identify you, may be retained.
8. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including encryption of passwords, encrypted connections, and access controls. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
9. Your California Privacy Rights
If you are a California resident, you have the following rights under the CCPA, subject to certain exceptions:
- Right to know / access — to request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of recipients.
- Right to delete — to request deletion of personal information we collected from you.
- Right to correct — to request correction of inaccurate personal information.
- Right to opt out of sale or sharing — we do not sell or share personal information, so there is nothing to opt out of; the right is noted here for completeness.
- Right to limit use of sensitive personal information — we do not collect or use sensitive personal information for purposes that trigger this right.
- Right to non-discrimination — we will not discriminate against you for exercising any of these rights.
10. How to Exercise Your Rights
To exercise any of these rights, email hello@geckomode.ai from the email address associated with your account, or include enough information for us to verify your identity. We will verify your request by confirming control of the account email and will respond within the timeframes required by law. You may use an authorized agent to submit a request on your behalf with proof of authorization. We will not charge a fee for a verifiable request unless permitted by law.
11. Children’s Privacy
The Service is intended only for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will delete it. If you believe a minor has provided us information, contact hello@geckomode.ai.
12. International Users
The Service is operated from the United States and intended for users in the United States. If you access the Service from outside the United States, you understand that your information will be processed in the United States, where data-protection laws may differ from those of your jurisdiction.
13. Third-Party Links and Services
The Service may reference or link to third-party services, including brokers and our payment processor. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. Review their privacy policies separately.
14. Changes to This Policy
We may update this Policy from time to time. If we make material changes, we will revise the “Last updated” date and may provide additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Policy.
